DMV Scientific Evidence
Generally speaking, investigating DMV scientific evidence will occur when a person is facing a suspension or revocation of their driving privilege following an arrest or detention for DUI or a “zero tolerance” violation. In some instances, your CDA advocate may also seek to investigate DMV scientific evidence when preparing to conduct a Physical and Mental hearing when the DMV suspects that a driver may be addicted to medications, drugs, or alcohol.
Those items of scientific evidence most commonly introduced at a DMV administrative hearing are issues related to blood, breath, or urine samples seized during the course of a police investigation. To investigate, evaluate, and attack scientific evidence, California Drivers Advocates uses the services of a forensic toxicologist with more than 20 years of experience in the field. Your assigned toxicologist is an expert in reviewing the manner in which blood or breath samples are collected. He will evaluate the chain of custody of the scientific evidence and will review the manner in which that evidence was handled, tested and processed. Ultimately, your CDA Toxicologist will be prepared to testify as an “Expert Witness” at the DMV administrative hearing to rebut the DMV’s belief that the blood, breath or urine samples are accurate.
