What is a Physical Reexamination Hearing?: Driving within the State of California is a conditional privilege which essentially means the State will allow you to drive but, there are strings attached. One of the requirements is that all drivers maintain a certain level of physical health or fitness to be presumed able to safely drive on our public roadways. From time to time, the Department of Motor Vehicles (DMV) receives information suggesting that a particular driver may have a physical ailment, illness, disease, or limitation which renders them unable to drive safely.
This information can come from a variety of sources:
- Your physician or Surgeon
- Emergency Medical Personnel
- Law Enforcement Officers
- Letters from friends, family members, neighbors or anonymous witnesses
- Your driving record
- Application for or renewal of your driver license where you admit a medical problem
Once the DMV suspects that you may have a physical condition affecting your ability to drive, they are mandated by law to investigate the matter and make a determination about your driving future. The process by which the DMV makes its determination is called the “Physical” Reexamination Hearing. Often referred to as a “P & M” Hearing, this Reexamination requires that the driver appear before a Hearing Officer at a Driver Safety Office and undergo an evaluation to determine if immediate suspension of the driver license is warranted. The Reexamination process can include a “face to face” interview, medical evaluations, written testing, vision testing, and behind –the-wheel testing.
The Physical Reexamination Hearing can result in the full reinstatement of your driving privilege. However, if things don’t go well, it can result in medical probation, limited driving, or the complete suspension/revocation of your driving privilege.
Make no mistaken the Physical Reexamination Hearing is an unfriendly event where it is presumed you are unsafe to drive. The Hearing Officer will presume that the information they possess is sufficient to remove you from the road. Fortunately, all is not lost. You have the absolute right to fight for yourself. You also have the right to be represented by a DMV Defense Expert.
Am I Required to Participate in a Physical Reexamination Hearing?: It IS NOT illegal to refuse to participate in a Reexamination Hearing with the DMV. You cannot be convicted of a crime and a fine cannot be levied against you because you refuse to play their game.
If you do not participate and complete the Physical Reexamination, however, there is a 100% probability that the DMV will suspend or revoke your driving privilege. Consider this………..The DMV has received information that you are not safe to drive because of some physical or medical ailment. If you refuse to rebut that information, it is presumed the allegation is correct and the DMV will suspend the driver license…Period! Also, once the driver license is suspended or revoked, it remains in that status until you finally do participate in a Physical Reexamination Hearing. Whether it is for one day or the remainder of your life, the DMV simply WILL NOT reinstate your driving privilege until you have played their game.
