Requesting & Scheduling a Priority Reexamination hearing

What is a Priority Reexamination Hearing?  A “Priority” Reexamination Hearing before the California Department of Motor Vehicles (DMV) is conducted at a regional office known as the Driver Safety Office (DSO). A Reexamination is conducted as a “Priority” if it is believed that a driver suffers with a medical issue of such consequence that they pose an immediate hazard to the driving public. The purpose of the Priority Reexamination Hearing is to allow a DMV Hearing Officer to determine if a driver should be immediately stripped of their privilege to drive because it is too dangerous to allow them to continue.

A “Priority” Reexamination Hearing will cause a DSO to drop everything else to evaluate a driver immediately. This type of hearing must be conducted “in-person” and must be conducted within 5-days of the driver receiving the “Notice of Priority Reexamination.” 5-days provide little time for a driver to prepare for a hearing but, with proper guidance, it can be done. This type of hearing can be WON!

What Happens if I Don’t Appear at a Priority Reexamination Hearing?  The moment you receive a “Notice of Priority Reexamination” from a California Peace Officer, your driving privilege is in danger. The DMV has already begun the process of suspending or revoking your driver license. Your ship is sinking and you only have 5-days to correct the problem.

Make no mistake, if you fail to appear at your local Driver Safety Office (DSO) within the first 5-days following receipt of the “Notice of Priority Reexamination,” your driver license WILL BE SUSPENDED OR REVOKED…….Period!

Furthermore, the DMV will not return your driving privilege until you do appear and complete the Reexamination process. Your driver license will remain indefinitely suspended until the DMV is convinced you are safe to drive. Fortunately, this can be avoided.
