What is a Hearing for Order of Suspension/Revocation?   The California Department of Motor Vehicles (DMV) is empowered to suspend or revoke a person’s driving privilege for a variety of reasons. If you have received an “Order of Suspension/Revocation” the DMV believes they are justified in taking you off the road for some reason. They have both the power and the intent to do so.

The most common causes for receiving an Order of Suspension/Revocation are:  Following a DUI Arrest, Accumulating too many moving violations, Failing to maintain auto insurance, Having a Physical or Mental Ailment,  Being involved in a fatal accident,  Addiction to or habitual use of meds or drugs. Committing an act of fraud and, or Addiction to or habitual use of alcohol.

If you received an “Order of Suspension/Revocation” from the DMV, this means your driver license is in immediate jeopardy of being suspended or revoked. The only way to protect your driving privilege is to schedule, conduct, and win an Administrative Hearing before the DMV. Administrative hearings are formal legal proceedings, conducted at regional offices of the DMV called the Driver Safety Office and should not be attempted without professional help.

Requesting and scheduling a DMV Administrative Hearing is the critical “first step” in defending yourself. There are strict time limits to requesting a hearing that range from 5 days to 14 days, depending upon the facts in your case. The bottom line………..If you are not timely, you will be denied a hearing and your driver license will be suspended.

What Happens if I Don’t Schedule a CVC 21061 Re-Examination Hearing?

Read the “Order of Suspension/Revocation” carefully. It will identify the reason the DMV is taking this action and will also identify the time in which you must respond. Failing to schedule a DMV Hearing IS NOT a crime and you cannot be fined. It is, however, a mistake. If you do not act, the DMV WILL automatically suspend your driving privilege, without regard for your need to drive. Essentially, you lose by default. This is unnecessary and can be quite costly in terms of lost productivity and an increase in insurance rates. Don’t let this happen.
